DriveON and MTO safety inspection insurance requirements.

A garage applying to perform Ontario safety inspections needs a business insurance certificate that shows the required coverages, limits and additional-insured wording.

The Ontario DriveON requirements are specific. Ask the broker to prepare the certificate from the actual issued policies, and compare it with the current ministry instructions before submitting the application.

Who can issue safety standards certificates

Ontario’s DriveON program replaced the former paper-based Motor Vehicle Inspection Stations program. Safety inspections must be completed through a Vehicle Inspection Centre licensed by the Ministry of Transportation, and only a registered DriveON technician may perform and sign off on an inspection after confirming the vehicle meets the applicable standards.

Commercial general liability requirement

Ontario currently requires the Vehicle Inspection Centre owner’s Certificate of Insurance to show commercial general liability of at least $3 million per occurrence for property damage, bodily injury and personal injury. The ministry’s specified additional-insured wording must also appear in the certificate-holder and additional-insured areas for this CGL coverage.

Garage liability requirement

The certificate must show standard garage liability of at least $3 million per occurrence for property damage and bodily injury, and Ontario states that the certificate must specifically list “garage” for this coverage. The published exception is for inspection centres whose test class is fleet.

Customer-vehicle damage limits

Ontario requires legal liability for damage to customer vehicles while in the centre’s custody and control of at least $200,000 for collision and at least $300,000 for specified perils or comprehensive coverage. These figures should be confirmed against the current DriveON page and the limits actually shown on the Garage Certificate of Insurance.

Additional requirement for a mobile VIC

For a mobile Vehicle Inspection Centre, when applicable, Ontario also requires automobile insurance for a vehicle used to transport emissions-testing equipment with at least $3 million for third-party property damage and bodily injury. Tell the broker which vehicle carries the equipment, who operates it and how it is used.

What the certificate must identify

The legal business name and locations must match the DriveON application and insurance policies. Ontario currently instructs applicants to name His Majesty the King in right of Ontario, as represented by the Minister of Transportation, at the ministry address stated on the DriveON page. If an umbrella policy supplies a required limit, the certificate must specifically connect it to that required coverage.

  • Correct legal entity and Vehicle Inspection Centre location
  • Required CGL and garage-liability descriptions and limits
  • Customer-vehicle collision and specified-perils or comprehensive limits
  • Applicable mobile-VIC automobile coverage
  • Exact ministry certificate-holder and additional-insured wording
  • Policy dates that cover the application and intended operating period

Startup checklist for the broker

Send the broker the current DriveON insurance requirements, legal business documents, proposed test classes, locations, services, driver and technician details, projected revenue and payroll, customer-vehicle concentrations and any mobile equipment information. Allow time for underwriting and certificate revisions; the certificate cannot create coverage that the issued policies do not provide.

Common questions

What insurance does a DriveON Vehicle Inspection Centre need?

Ontario currently lists at least $3 million CGL, at least $3 million standard garage liability, customer-vehicle damage limits of at least $200,000 for collision and $300,000 for specified perils or comprehensive, plus additional requirements and wording described on the DriveON page.

Does the insurance certificate need to say “garage”?

Yes. Ontario’s current DriveON instructions say the certificate must specifically list “garage” for the standard garage-liability requirement, except for inspection centres with a fleet test class.

Does MTO need to be an additional insured?

The current DriveON instructions require the specified ministry entity and address to appear as certificate holder and additional insured with respect to the required commercial general liability coverage.

Can an umbrella policy supply part of the required limit?

Ontario says that if an umbrella form provides any required coverage, the certificate must specifically state how the umbrella relates to that coverage.

Is a safety standards certificate a warranty?

No. Ontario describes it as confirmation that the vehicle met minimum safety standards on the inspection date, not a warranty or guarantee of the vehicle’s condition.

Can any mechanic issue an Ontario safety certificate?

No. The inspection must be performed through a licensed DriveON Vehicle Inspection Centre, and the technician must meet DriveON registration and qualification requirements.
